Global Shop Compliance Training - Canada

What is Global Shop for Canada?

Some Amare products are available to Canadians  for personal use only through the Global Shop. These are specific Amare products and are often referred to as “not for resale” (or NFR). For more specifics about Personal Use purchases please visit Health Canada’s guidelines here.

These product purchased through Global Shop, are not approved, licensed or sold in Canada and Canadian law places limits on how they can be promoted and discussed.

You can tell a product goes through Global shop (and has strict limitations on how they can be promoted) if you:

  1. Purchased it through the Amare Global Shop or;
  2. It contains a non-Canadian label (U.S.A label, no NPN number, etc)

If it meets any of these, there are strict limitations on this product.

What “Personal Use” Means and What Can you Say:

  • Personal Use purchases are from the Amare Global Shop and for your own use.
  • You can make very limited personal -use references (with required transparency)
  • Be honest that the products are imported from the U.S.A and are not sold or approved in Canada.
  • If you choose to reference (not promote) the product publicly it must be passive, factual and non-promotional
    • Example: “This is something I use personally. It’s not approved or sold in Canada.”
    • Example: “Sharing personal experience only – not selling or promoting anything”
  • If you choose to compliantly reference (not promote) a Global Shop product you must also include the following disclaimer: “This product is not licensed, approved or sold in Canada and does not have a Canadian NPN.”

The promotion of Global Shop products that fail to adhere to these guidelines may be subject to non-compliance and could jeopardize Amare Global’s continued business operations within Canada. To get an idea of the difference between a compliant and a non-compliant post, see the example below:

Why this is not allowed: 

In accordance with Health Canada standards, a product that is not registered and licensed with Canada cannot be promoted or resold within the country. As a Canadian Brand Partner, promotional posts are considered noncompliant on a federal level. Because the product is not identified as a non-approved product (per Canada) and there is solicitation for more information this would be seen as a violation of Canadian Law.

Simple Guidelines to Remember:

  • If it feels like marketing, selling, or encouraging someone to buy — it should be avoided.
  • Under Canada’s rules:
    • Personal use is allowed
    • Promotion is not
  • This applies to public posts and private messages.
